9 Month Academic School Year Agreement : $110.00USD - billed monthly

 

I understand that I am referred to as both the "Client" and the "Member" for the purposes of this agreement.

 

Agreement Duration and Automatic Renewal:

Agreement is in force for 9 months from the Agreement Start Date, with automatic renewal for 9 months at the end of each Auto Pay schedule, unless cancelled by the Client with approval of cancellation policy guidelines.

Agreement to Pay Recurring Fees:

The Client agrees to pay the United Capoeira Association Los Angeles monthly recurring fees as follows:

Amarelo (students 18+ years) School Year Agreement for $110.00 via Client authorized automatic credit card or debit card charges.  Payment for monthly Auto-pay method by any means other than Client's credit or debit card is not permitted.

(a) I agree to purchase the Amarelo (students 18+ years) School Year Agreement for $110.00, as an automatic charge to my credit card or debit card each month for a contract period of 9 months.

(b) I hereby certify that I am the holder of the credit card or debit card detailed below.

(c) I understand that I will be notified if my credit card or debit card payment fails to authorize for any reason, and that a $20 late fee will apply if I do not provide a valid credit card or debit card information within 10 calendar days of the original rejection date.

(d) I understand that my service will be deactivated if my account becomes more than 30 calendar days late.

B) Amarelo (students 18+ years) School Year Agreement: $110.00

 

You may opt out from plan B within the first 3 days without penalties.

After that, you agree to the following opt out rules:

 

FOR PLAN B)

Client may opt out of plan A with a 30 day written notice submitted in person to the United Capoeira Association Los Angeles and will agree to pay the following fees depending on the month that the request for opt out is made.

- During the first two months: Balance due $314.00

- Between the 3rd and the 6th month: Balance due $236.00

- Between the 7th and the 9th month: Balance due $157.00

 

GENERAL:

We require written notice of your wish to cancel this agreement at least 30 days prior to the end of your chosen monthly auto renew program.  This written notice can be submitted to the United Capoeira Association Los Angeles in person or via email through the "Contact Us" page of the following website:  www.capoeiraucainla.com.

INJURY:

Client may freeze his/her agreement due to doctor approved injury for a period of up to 6 months. Written notice from doctor must be submitted for approval in order to initiate temporary freeze period . Upon more serious injury that requires a period of more than 6 months to heal, from time of written doctors notice, client may cancel remainder of agreement.

RELOCATION:

Upon receipt of satisfactory proof of relocation of more than 30 miles, client may cancel remainder of agreement.

 

TERMS & CONDITIONS

 

LIABILITY WAIVER AND RELEASE

The Member understands and agrees that strict observation of the United Capoeira Association in Los Angeles’s rules and regulations and the rules and regulations relative to martial arts training, including the use of protective equipment, is required. The Member understands and agrees that the use of the United Capoeira Association in Los Angeles’s facilities and the Member's presence at the United Capoeira Association in Los Angeles’s facility are at the sole risk of the Member. The Member understands and agrees that martial arts involves skills and training which include violent and sudden movements and that in connection with the training and instruction, there will be physical contact between instructors and Members and between and among the Members and that such contact may result in personal injury to the Member, despite precautions taken to avoid such injuries. Member hereby consents to engage in such contact as may be necessary or required by Member's participation in the training program and/or classes.

Member, on behalf of him/herself and anyone claiming by or through the Member, hereby holds harmless, releases and forever discharges the United Capoeira Association in Los Angeles and its instructors, agents, employees, operators and authorized representatives from any liability, claim, loss, including loss of property, damage, personal injury, or expense incurred by the Member and arising from the Member's execution of this agreement, payment processing, participation in any program offered by the United Capoeira Association in Los Angeles, including, but not limited to, any injury or damage caused by the negligence or willful misconduct of the United Capoeira Association in Los Angeles, its instructors, Members, agents, employees, operators, or authorized representatives. The Member specifically understands and agrees that he/she is assuming the risk of any and all injuries that he/she may suffer or incur as a result of his/her execution of this agreement and participation in any program offered by the United Capoeira Association in Los Angeles.

SIGNATORIES:

Any person(s) signing this agreement, whether as a Member, co-signer or otherwise shall be jointly, severally and individually liable to the United Capoeira Association in Los Angeles for the full contract price as if such person signed as the Member. All persons signing this agreement assume responsibility for all costs of collection, including but not limited to collection agency fees, court costs, attorney's fees, and late charges that may be incurred in the event of a default. Any person(s) signing this agreement authorizes the use of a disclosed e-mail address for billing purposes and acknowledges that e-mail text may include financial information pertaining to the membership.

ACCEPTANCE OF MEMBER:

By signing this agreement, Member agrees to fully and completely comply with all terms and conditions hereof and the United Capoeira Association in Los Angeles’s rules and regulations. Failure to comply with the United Capoeira Association in Los Angeles's rules and regulations is grounds for immediate suspension or termination of the Member. The failure or inability of Member to use the facilities, classes or services of the United Capoeira Association in Los Angeles for any reason, except as otherwise provided herein does not relieve or suspend the Member's obligation to make all payments required under this agreement on a timely basis, nor entitle the Member to a refund or credit. The Business and those acting under its authority reserve the right to use photographs, videotapes, artwork or other likenesses of the Member for marketing, trade, publishing or any other lawful purpose. Member understands and agrees that full payment of tuition is not a guarantee or promise of advancement
